WHO IS RESPONSIBLE FOR APPLYING ITALIAN DECREE 81/08? WHAT RISKS ARE THERE IF THE FORESEEN OBLIGATIONS ARE NOT COMPLIED WITH?
The main person responsible for applying Italian Legislative Decree 81/08 is the employer.
If the legislation is not respected, there are pecuniary and criminal sanctions which are even substantial.
WHO DOES ITALIAN LEGISLATIVE DECREE 81/08 APPLY TO?
Once of the greatest changes in the Consolidated Act on Occupational Health and Safety (Italian Legislative Decree 81/08) consists in an amplification of its range of application. In fact, article 3 "Field of application" paragraph 1 says:
"this legislative decree applies to all sectors, both private and public, and any kind of risk."
Then adds in paragraph 4:
"This legislative decree applies to all workers, employees and self-employed individuals, as well as those with an equivalent status, without prejudice to what is foreseen in subsequent paragraphs of this article".
WHAT IS THE REFERENCE LEGISLATION FOR WORKPLACE HEALTH AND SAFETY?
The reference legislation for workplace health and safety is Italian legislative decree 81/2008.
